These are the rules we get asked about most at the counter, in Carver and in Bourne. They apply to adult recreational use anywhere in Massachusetts, not just at our two stores.

How old do you have to be to buy cannabis in Massachusetts?
You must be 21 or older to buy or grow adult-use cannabis in Massachusetts. There is no exception for visitors, and no medical card is needed to shop at a recreational dispensary.
The Cannabis Control Commission states plainly that you must be 21 years or older to purchase or grow adult-use marijuana. Both Capeway stores are recreational, so anyone 21 and over can shop without registering for anything.
What ID do you need at a Massachusetts dispensary?
You need a valid government-issued photo ID to buy cannabis from any licensed Massachusetts retailer. Your ID is checked at the door before you can enter the sales floor.
The Cannabis Control Commission requires a government-issued ID to buy from a Marijuana Retailer. At Capeway we accept an unexpired driver license, state ID, liquor ID or passport. We cannot accept temporary licenses, and a photo of your ID on your phone is not a government-issued ID.
How much cannabis can you carry in Massachusetts?
Massachusetts law lets you carry up to two ounces of cannabis on your person. That is the legal limit in public, whether you are walking around or driving.
This is the rule people most often get wrong, because the limit used to be lower and plenty of older articles still say one ounce. The Cannabis Control Commission is the authority: two ounces on your person.
How much cannabis can you keep at home?
You may possess up to 10 ounces of cannabis in your home. Anything over two ounces at home has to be locked in a secure place.
The Cannabis Control Commission recommends storing all cannabis products in childproof packaging and locked away, to keep children and pets safe. That is worth doing even when you are well under the limit.
Can you consume cannabis in public in Massachusetts?
No. It is illegal to consume cannabis in any form in a public place, including smoking, vaping, and edibles.
The Cannabis Control Commission extends this to federal land, which matters a great deal on Cape Cod. The Cape Cod National Seashore is federal land, so consuming there is prohibited even though cannabis is legal in Massachusetts. Beaches, parks, sidewalks, and parking lots are all public places.
How do you legally carry cannabis in a car?
Cannabis must travel in a closed container, and it cannot be open in the passenger area of the vehicle. The rule works the same way as the open container law for alcohol.
An open container in the passenger area carries a civil penalty of up to $500, per the Cannabis Control Commission. The safest approach is to leave the dispensary bag sealed and put it in the trunk. Driving under the influence remains a criminal offense.
Can you take cannabis out of Massachusetts, or on a plane or boat?
No. It is against the law to transport cannabis by plane, train, boat, or any other means outside of Massachusetts. You also cannot mail it.
This is the one that catches visitors out. Cannabis is federally illegal, so crossing a state line or boarding a plane with it breaks federal law no matter how legal your purchase was here. If you are travelling to the islands or off Cape, check directly with the carrier before you travel, and buy what you plan to use while you are in Massachusetts.
Can you grow cannabis at home in Massachusetts?
You can grow up to six cannabis plants at home for personal use. A household with two or more adults may grow up to 12 plants total.
